We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

    • You have the right to correct Personal Information about you that we have that is incorrect. Upon verification of the contested Personal Information, we will correct or delete the incorrect Personal Information.
  • Right to Opt-Out of Sale
    • You may opt-out of the sale or sharing of your Personal Data to third parties, by updating your preferences at Your Privacy Rights or by calling us at 877-774-4311.
    • You may also use certain preferences signals to opt-out automatically with all businesses that you interact with online, including our Site. If you enable one of these browser-based preference signals, then upon receipt or detection, we will endeavor to recognize and treat the signal as a valid request to opt out. If you use different browsers or profiles, you may need to enable the preference signal in connection with each browser and profile for us to associate the signal with you.  Additionally, if you delete or reset your browser settings you may need re-enable your opt-out preference signal.

Exercising Your Rights to Know, Delete, or Correct

To exercise your rights to know, delete described above, please submit a request by either:

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information. To designate an authorized agent if you are a California resident, the agent must be a natural person or a business entity that is registered with the California Secretary of State.

If you would like to designate an agent to act on your behalf, you and the agent will be required to provide us with proof of the agent’s identity and proof that you gave the agent signed permission to submit a request on your behalf. Additionally, you will be required to verify your identity by providing us with certain Personal Information as described above or provide us with written confirmation that you have authorized the agent to act on your behalf.

Please note that this subsection does not apply when an agent is authorized to act on your behalf pursuant to a valid power of attorney. Any such requests will be processed in accordance with respective state law pertaining to powers of attorney.

You may only submit a request to know twice within a 12-month period. Your request to know or delete must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative, which may include:
    • Our verification of your full legal name, home address, and last two purchases.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.

You do not need to create an account with us to submit a request to know, delete, or correct.

We will only use Personal Information provided in the request to verify the requestor’s identity or authority to make it.

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us at info@preferredcontrols.com.

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account.  If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request.   The response we provide will also explain the reasons we cannot comply with a request, if applicable.  For data portability requests, we will select a format to provide your personal information that to the extent technically feasible, is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your data rights. Unless permitted by applicable state law, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.]
